If these Terms conflict with a written agreement governing products or services purchased from Smile Global, the applicable written agreement will control with respect to those products or services.
Access to the Smile Global customer portal, support systems, billing systems, or third-party service platforms may also be subject to separate terms.

You agree not to:

To the fullest extent permitted by law, Smile Global’s aggregate liability arising from or related to the public Website will not exceed one hundred dollars ($100).
These limitations do not apply where liability cannot lawfully be excluded or limited. Liability relating to purchased services is governed by the applicable service agreement rather than these Website Terms.
11. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Smile Global and its members, employees, contractors, representatives, and affiliates from claims, liabilities, damages, judgments, losses, and reasonable costs arising from:
- Your unlawful or unauthorized use of the Website;
- Your material violation of these Terms; or
- Content or information you submit through the Website that infringes or violates another person’s rights.
Smile Global may assume control of the defense of a covered claim, and you agree to provide reasonable cooperation.
12. Restriction of Access
We may restrict or terminate access to the Website when we reasonably believe a user has violated these Terms, threatened Website security or availability, engaged in fraudulent or unlawful conduct, or exposed Smile Global or others to potential harm.
13. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
To the extent a dispute concerning the public Website is not governed by a separate written agreement, the parties consent to the exclusive jurisdiction of the state and federal courts located in or serving Ventura County, California.
Nothing in this section prevents Smile Global from seeking temporary or emergency relief in another appropriate jurisdiction to protect its systems, intellectual property, or legal rights.
14. Changes to These Terms
We may update these Terms periodically. When we do, we will revise the “Last Updated” date at the top of this page.
Changes become effective when posted unless a later effective date is stated. Your continued use of the Website after updated Terms take effect constitutes acceptance of the revised Terms.
15. Severability and Waiver
If any provision of these Terms is found unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.
A failure by Smile Global to enforce a provision does not waive its right to enforce that or another provision later.
16. Entire Agreement
These Terms and the Privacy Policy constitute the entire agreement between you and Smile Global concerning use of the public Website.
They do not replace or modify any separately executed agreement governing products or services supplied by Smile Global.
